ACCURATE
Breathe Legal™ Breathalyzers are calibrated every 30 days or 300 uses, whichever occurs first. Our machines use Heated Fuel Cell Technology, the same technology used by law enforcement to test blood alcohol content (BAC). Consumer awareness of Breathe Legal™ machine accuracy benefits the Breathe Legal™ image with the community, establishments, advertisers and franchisees.

PROTECTIVE
The Breathe Legal™ machine requires the patron push the “Accept” button prior to testing their BAC. By pushing the Accept button, the patron is agreeing to the following disclaimer:

The user is solely responsible for their acts and for monitoring their alcohol consumption. Be aware that even if your test result is below .08% BAC, you may still be too impaired to drive legally. Holders of a CDL may have different BAC limits while driving. Your Blood Alcohol Content (BAC) may increase or decrease after this test based on your rate of alcohol consumption. Test again to see the change in your BAC.

In a landmark case, a drunk driver coming from a New York Giants football game struck another vehicle. A 9-year old girl was paralyzed in the crash, and the jury in the trial against the drunk driver awarded her family $135 million. Through the dram shop liability law, the young girl's legal counsel sued not only the drunk driver, but also the beer sales concession company at the football stadium.

On June 3, 2010, Applebee's patron Randeep Bains allegedly "left the restaurant... in an obviously intoxicated state," according to the suit. Traveling roughly 100 miles an hour down a local highway, Bains lost control of his vehicle, causing it to roll several times. Due to the rollover, passenger Anthony Franklin suffered fatal injuries. This is one of numerous plaintiffs suing the National Chain for Dram Shop Liability. Going into mediation, all 3 plaintiffs were asking for $10 million each.

These are just a few of many examples of both states cracking down on establishments serving intoxicated persons (SIP), and of attorneys actively pursuing alcohol related liability cases. Under dram shop liability laws, a party injured by an intoxicated person can sue establishments contributing to that person's intoxication.

A Breathe Legal™ Franchise is provided the sole exclusive rights to place Breathe Legal™ alcohol Breathalyzer machine with a pre-defined territory. Each exclusive territory of 200+ that serves alcohol , including at least 50 with full service bars.

A Franchisee has the ability to place Breathe Legal™ machines within any establishment or venue that sells or serves alcohol. These establishments include bars, night clubs, banquet halls, sports venues, restaurants, fraternity houses, charity events, etc.

A Franchisee receives both vending and advertising revenue from the Breathe Legal™ machines. This revenue is deposited every week directly into the Franchisees' bank account.

Breathe Legal™ estimated initial investment is illustrated below. Start-up costs below reflect a single territory. Additional territories are available for only $8,000 per area. Franchisee cost for the Breathe Legal™ machine is $2,450.
